Excerpt from Construction and Constitutionality of the Long and Short Haul Clause of the Interstate Commerce Act as Amended: June 18, 1910 The proviso to the above section is practically the same as the proviso contained in section 4 of the Act to Regulate Commerce before it was amended on June 18, 1910. The first part of the section was, however, before the amendment of June 18, 1910, as follows: "That it shall be unlawful for any common carrier subject to the provisions of this act to charge or receive any greater compensation in the aggregate for the transportation of passengers, or of like kind of property, under substantially similar circumstances and conditions, for a shorter than for a longer distance over the same line in the same direction, the shorter being included within the longer distance." It will, therefore, be seen that, considered from the standpoint of the question now under discussion, the important amendment introduced by the act of June 18, 1910, was to omit from the section, as it previously was, the words "under substantially similar circumstances and conditions."
